I own a small rental property in Texas. On August 31st, my tenant gave the required 30-day notice and we scheduled a walk-thru when she had finished moving. During the walk-thru, she mentioned that there were "some little bugs." Actually, the place was absolutely crawling with roaches and the kitchen cabinets, shelves, pantry, drawers and door frames were nasty with accumulated roach feces and egg pouches. They were even in the refrigerator, the freezer and the dishwasher. I called a pest control company when my fogging and roach spray efforts failed; to date, they have thoroughly sprayed the interior and the exterior base perimeter twice and may have to return a third time. In the meantime I have a dusting of roach powder on all the interior surfaces and I check the empty condo daily to do a "body count" ... after 3-1/2 weeks, I still find newly hatched roaches and the occasional adult lying feet up in the powder. Obviously I can't rent or even show the property until the roaches are eliminated and the situation is under control. My question: When rental income is lost due to an infestation like this, is it deductible from the security deposit as "damages"? Thanks for your help.
