I own a home with another person. The mortgage is only 4 years old. I recently moved off of the property and there is another person living there other than the co-borrower. I never agreed to this person living there and no lease agreement has been signed. I do not want this person living on my property for failure of the mortgage being paid.


I have a few questions. What are my rights as a homeowner of evicting this person from my home? Can a lease be signed with just one homeowner and not both? What are my options of removing my name from a lease without the coborrower agreeing to it? Can I force the sale?

Thanks for any help or info.

Since the other owner is an equal partner in the property, they have the right to have someone stay with them.

While the co-owner can't sign a lease without you, they don't need a lease to have someone live there.

You can, however, sue to have the co-owner buy you out or force a sale.
