My husbans is a US citizen i am from mexico and we are about starting the process to aply for us recidency but we have been married since november 2008. Can he claim me as a dependant in his taxes return even though i dont have a social security number?
and if it is so...How can he do it?

You should file jointly and you sign a statement requesting to be treated as a resident alien for ALL of 2008. You will have to include ALL 2008 world-wide income on the tax return if you file jointly.

You will also need to submit Form W-7, along with a notarized photocopy of your passport, to get an Individual Tax Identification Number (ITIN). This Form W-7 is submitted with the 2008 tax return.

Since your husband is U.S. citizen, he can only file as married filing jointly or married filing separately. He can file joint return even when his spouse is foreign alien and has never been to the U.S.
