Hi,

I was in US for the whole financial year 2008 and had to go back to India by the end of Jan '09. I came back to US in April '09 but didn't get time to file my tax return.

Request you to please let me know the implication of missing a tax return last date.

To make it clear I was in US with my wife and my kid and I am supposed to get some return from IRS.

If you have a refund, you do not pay any interest or penalty. If any tax is due, you must pay it with interest and penalty.

As noted by Mukata, there are no penalties or interest if you have a refund due.
