I am share holder for a NJ based consulting firm, Our CPA has given the following guide lines

1) for H1b we have with hold state+fed+social+ Med and company has to pay employer taxes equal amount of FICA(social+med) which i agree

2) for opt and cpt we have to withhold state+fed and we have to pay employer taxes of 13% ???????????????? is this right?????????? we have been doing this for last 3 years, if this is not right how do we clam back the employer taxes we payed for opt employees.

For F1/OPT/CPT who have not completed 5 years, you do not pay any employer taxes. Your CPA should file amended return for employment taxes.
