Hi! I'm new here so forgive me if this has been answered. (I searched Q&A but couldn't find it.
My daughter and her son born in 2007 lived with me in 2008 until she got a job and moved out in Sept of that year. I was planning on using them as dependents for tax purposes. However, if she uses her son as a dependent, she can qualify for the EIC. I have tested her ablitity to do so on the IRS web site and it says she is eligible. My question is: can I still claim her as my dependent? The only information I can find on this subject is that she cannot claim the EIC if she has NO child AND I claim her as a dependent. It does not specify the outcome if she has a child. Although I put that varible in the IRS tool and it said she was eligible, it will not work on my tax software and I don't know why. By the way, I know if she uses the EIC that I cannot claim her son in any way. I just want to know if I can claim her. Sorry, Tink

If you claim her as a dependent, then she CANNOT claim the EIC.
