Hello,

I been married to my wife for 1.5 years , she lives in the philippines along with her two kids that i been taking care of for now 2 years. Both my wife and kids are waiting for a visa. I know i can claim my wife under w7 but can i claim the kids also?

You can not claim kids on your 2008 tax return.

There are several tests to determine if a child is a dependent.
One of those tests requires that they be citizens or residents of the United States. The children in the Philippines seem to fail this test.
