My fiance and I are wondering who should claim our son. I worked for only 2-3 months this year, so he made way more money than me. We wanted to know if I HAVE to claim him since his SSI check comes in care of me, or if we would benefit more if my fiance claimed him?

If both are custodial parents, then one with higher AGI (on tax return can claim the child.

What MukatA says is true ONLY IF your fiance is your child's biological parent.

If not, then he must meet the requirements to claim your child as a dependent by providing him a place to live for ALL of 2008.

We live together and have been since before our son was born, so we both have equal right to claim him...SSI wont take money from us if we get a decent amount of money back will they?
