Hi All,

I am on H1B status from october 2008. My Husband is on Opt from oct 2008. My question is Can we file our taxes jointly? On w4 form both of us have kept as single independent working people. I feel a lot of tax is being cut as I put "single" on my w4 form. I have been working since feb 2008. My OPT started from Jan 2008. Any kind of information regarding this is highly appreciated.

Yes, you can file jointly if you both CHOOSE to be treated as resident aliens for all of 2008.
