Hi,

I was working in US on L1B Visa from Sep 1,2007 to till date and i was paying every month $1200 for taxes. Will i get any refund if i am leaving to India as i m not resident of US? Please help me out ASAP.

You will NOT get a refund for the FICA (Social Security and Medicare) taxes.

You MAY get a partial refund for the federal and state income taxes withheld.

Did you not file a 2007 tax return (probably Form 1040NR or 1040NR-EZ)??

For 2008, you will need to file a dual-status return to claim any refund due from the IRS.

For your state return (assuming you worked and lived in a state with an income tax), you will file as a part-year resident for both 2007 and 2008.
