my husband is behind on his taxes so I know any refund we are due will go to his child's mother. if i file married filing separate will i still get my income tax refund?

You can get your part ( based on your income) if you file jointly ( normally giving a better tax rate) if you merely file the injured spouse filing with the paperwork. They keep his part, you get your part.

but filing seperate will do it also,
