View Full Version : Tenant in a foreclosed house in FL.

I am a tenant in a house going through the foreclosure process... it began in March 2008. I spoke with an attorney and was advised not to pay my rent to the landlord, but to pay to the mortgage company... we tried getting in touch with the mortgage company, but they would not work with us because we are not on the mortgage... we addressed this with the landlord and informed them of our intentions and were advised that they would pursue a short sale for us... our lease is up on Sept 1, 2008 and we received an email today (8/16) from the landlord telling us to vacate the property as of Sept 1 - that the sheriff will be locking the property down as of that date. We live in orange county, Orlando, FL - what do I do?

Yes, sounds like some poor legal advice, first you owed the landlord, not the mortgage company, you paying the mortgage company may have extended the time before eviction, but it gives the landlord full rights to evict you in every state but California..

So yes be ready to move

Actually, it doesn't sound like they are being evicted. Their lease is just not being renewed when it ends. It ends September 1st, they are being told that they need to leave by September 1st. I'm not entirely sure why the tenant has a question about what they can do at that point, since it seems pretty clear-cut to me.
