The company was out of business in April, 2005. We made some payments to this company for the first 3 months in 2005. Their phone is disconnected. We are not able to contact anyone in the company. No tax id obtained. No withholding. Is it still make sense to file 1099 for this company?

Of course this is a good reason to have them fill out all of the paper work on a company you are going to pay. We require any company that is going to do work for us to supply thier tax id numbers prior to getting thier first check.

Not any help for your current problem, but perhaps some help for someone else reading this.

The fact that the company is out of business does not relieve them of tax filing obligations for the year.

Keep trying to contact the company. If you know anyone by name, you might try Googling the name.

Fr Chuck's advice is VERY GOOD!
