can a person on h4 get paid any referral fees on 1099?

Yes, the can get paid.

However, if they do get paid, it MAY be in violation of the provisions of their visa.

If so, it is a MINOR violation.

Referral fees for apartment referrals and such as effectively the equivalent of winning a lottery or sweepestakes, which are permitted under the visa provisions.

Regardless, you MUST report this income on a tax return if it exceeds a set amount. If you are filing jointly with your spouse, report it on the joint return on Line #21 of Form 1040.
