Hi I live in Toronto Canada and my brother was recently arrested for taking a car and they charged him with theft over 5000 and possession of Property Obtained By Crime the story was he got a call from my pregnant girlfriend and she had told him that she was feeling pain in her stomach and it could be possible labour so he ran to the store to get change for the bus and on his way back to the bus he seen the car running and the door was open so he went in the car and was on his way to his girlfriends house. After 5 minutes a cop pulled him over for cutting another car off and the officer asked him for his license and his registration and he immediately told the cop that the car was stolen. My question is for the sake of his son do you think he will get any prison time at all?

Hello Sam:

There's a lot more to it than that. Do I think he'll get prison time?? If he has no lawyer, and if he has a bad reputation in school, and doesn't make good grades, and if he has a juvenile record, and if he has an attitude, and, and, and... Yes, he could get prison time.

But, if all that above were the opposite, plus much more, then maybe not.

Very possibly - he stole a car.

Who's girlfriend is this? First you said it was yours, then later you said it was his. No big deal really.

If the girlfriend was able to call HIM, then why could she not call 911 for an ambulance?

I doubt that he will get jail time (as long as he hires a lawyer and has never been in trouble before).

I think the key here is getting a good lawyer... Like people have been saying, assuming he doesn't have a record, he can probably get off.
