My niece, was arrested for shoplifting at sears at a mall in Maryland one year ago.she stole a bracelet priced for $7 or $8( I do not really remember.)... a police officer came to the security room , pictures of her were taken and ,she was asked not to go to the mall for a period of one year. She was asked to pay $50 to sears holding. She was not fingerprinted nor convicted , she was not asked to appear in court.I was`actually at work when she called me to come and bring some kind of evidence that she was living in MD since she had a Georgia driver's license.I want to know if it is going tom reflect on a criminal background check, I'm petitioning for her green card.can this be an indherence to th process?
Ps.she is not a minor.

No, this is ( at least in my area) called a criminal tresspass warning, there will be a report or incident card on file at the local police station.
It will be on the daily log at the police station.

So I will not say it could never be found, but the warning means that if anytime during that year if she goes back into the mall, they can arrest her for criminal tresspass. *** or something similar in that area.

So there is no criminal record, the photo done at the mall is for the mall security records, they have a wall of them, they compare when looking though the hidden cameras at people in the store.

So no this will not show up in a background check, and it was not an arrest and not a conviction,
