Hi,

I don't know which form I sould use 1040NR or 1040 for year 2007; here is my situation.

I was a student from Sep 2002 to May 2004, then following by one year OPT. From Sep 2005, I went back to F1 visa again. Then, I changed my status from F1 to J1 since Auguest 2007; now, I'm working full-time for a non-profit orgnization as a researcher. I didn't have any income under F1 visa, besides some interests from bank saving. I only had income from Aug to Dec in 2007 under J1 visa.

1) Am I qualified for 1040NR/1040NR-EZ? or I should fill 1040/1040EZ? Which one is the best choice for me to get my money back?
2) Will I use the same form for year 2008?
3) Am I exempt from taxation or Social Security and Medicare tax?

I will very appreciate your help.

1) You are a resident alien; file Form 1040 or 1040EZ.

2) Yes.

3) No; you ARE liable for Social Security and Medicare taxes.
