We (me-h4 and my husband-h1) had stayed here in US for three months (april-june 2006) and taxes last year (married filing jointly) with my ITIN application.

As we were in INDIA while filing the returns,we gave INDIA address but I didnot get the ITIN.
But we got the refund amount credited into his US bank account.

Now again he is working in US from july 2007 and needs to file this time.
Again there is need for ITIN for me.

When I called to IRS office in Dalton to check whether i was issued ITIN last time , they said there was some problem and asked me to apply again.

Should we file the taxes along with ITIN application?
OR should I wait till i get ITIN and then file his tax return.

I joined my husband in dec 2007 though he is working from july 2007.

Will the refund vary since I was here for only less period during that year?

Can we do efiling from anywebsite even without ITIN?

You cannot efile without an ITIN. You may want to re-confirm that you were not issued one in 2006. The person you spoke with at the IRS may have been correct about not issuing you and ITIN, but they often make mistakes.
