Hi!
I wanna to know whether me and my wife should file as non-resident/resident alien for federal tax purpose.
I got the J-1 visa in Mar 2006. My wife got her J-2 visa and we came to america together on June. Afterthat my wife got her EAD on Oct2006 and she has a job since then. She is paying medicare and social security tax. We do not leave US in 2006 and 2007. I would like to ask a few questions.
1) Do I need to file as non-resident alien for 2007 income?
2) Should my wife need to file her federal return as non-resident alien also? I am quite confusing right now. The "tax advisor" of the university she is working suggests her to file 1040 for 2007 return.:confused:

You BOTH need to file separate tax returns as non-resident aliens, probably filing Form 1040NR-EZ.
