Hi,


I was on OPT (F1 VISA Status) between January 3rd 2007 - November 20th 2007. My status changed to H1B VISA on November 21st 2007. What forms should I fill in? I am a non-resident alien or resident alien? I am totally confused. I would really appreciate it if someone could advise me!!!

If you are single, you need to file Form 1040NR or 1040NR-EZ.

If you are married, you have the OPTION of filing jointly with your spouse and you BOTH choose to be treated as resident alien for all of 2007, filign Form 1040, 1040A or 1040EZ.

Since I am single, I will file form 1040NR and 1040NR-EZ

Also two more questions!

1. Do I have to file form 8843 also?

2. Since I worked in New Jersey, what New Jersey state forms should I fill in?

The NJ forms are NJ-1040.

Yes, you must also file Form 8843.
