I had worked for 3 years with J1 visa. (Sep.2004 ~ Aug. 2007)Last year, I filed a 1040NR with your advice. ( I was a dual status. Jan~Aug: 2 years Non, Sep~Dec:resident)
I have a question.
I got a H1 visa on Sep.2007 and moved from PA to NC.
I would like to know which form I need. I think I should file a form 1040A. My bank interst is less than $10. Should I show it for each state (PA, NC)?

Thanks.

Hello

J Visa holders enjoy exemptions for 2 out of 6 years of their stay in US.

Since you have crossed the 2 year exemption at the beginning of 2007, and you qualify as a resident based on Substantial presence test, you are considered a resident, go ahead and file a Form 1040 / 1040EZ.

Yes you have to file both PA and NC State Tax returns, for the period of your work in those states.

Please feel free to contact us for Tax preparation services.

Hope this helps!

I agree with VTE; you need to file as a resident alien for 2007.
