Hi,

I am On L1 visa during 2007 have SSN. My Spouse is in india and do not plan to join me but she has SSN which she has got during her last visit. Will we be able to file returns jointly. She is working in india do we need to show her income when filling returns.

If you end 2007 in the Un ited States AND will be here through at least May 2008, you will be able able to file jointly under the First Year Chioce program.

If you file jointly, she WILL have to declare her India income, but she will be able to claim the Foreign Tax Credit for taxes paid to India on that income.
