Dear Experts,

I am a fellow from Thailand with J-1 visa. I am employed by the U.S. federal government. On my earnings statement, there are deductions for both OASDI and Medicare. Am I eligible for exemption? If so, how do I file for the exemption?

Will I be eligible for any tax treaty such as Treaty Article Citation 22(1) in Publication 515? I do not know whether I am qualified under "fellowship grant".

Thank you in advance for your kind advice.

Heng

How long have you been in the US and how long on the J1 visa? That's going to have a big impact.

TTE has this one and I expect he will cover it with his normal thoroughness! :-)

Thank you both The Texas Tax Expert and AtlantaTaxExpert for your prompt response. I am sorry for a late reply as I was disconnected.

I had been on F-1 visa for 6 years for my graduate training. Recently I have received a J-1 visa for 2 years to work as a fellow. I appreciate your advice.

Because of your previous6 year's on F-1, youhave LOST your exempt status under the J-1 visa and are liable for all taxes (federal and state income, Social Security ann Medicare).
