You need to get an attorney who specializes in family law and adoption. This will not guarantee that your ex will sign his rights over, but it may help.

He is not paying child support? Is this court ordered? If so, you take him back to court for contempt.

You can't get him to sign over his rights unless he is willing to...you could mention by him signing over his rights and allowing your husband to adopt the child he won't have to pay child support.

But at any rate....if he is not willing to sign over his rights, the only thing you can do is petition to have his rights terminated. This is very hard to do, and if the bio father resists, it will be an uphill battle all the way....and the outcome most likely will be in his favor.
