    Can my husband adopt my daughter if the bio-dad is not in the birth certificate
    My husband and I have been together for four years and merry for one year. My daughter is six years old about to be seven but the bio-dad has never been around and she has my madden name. Is there any way we can do the adoption with out having to deal with the bio-dad because my husband is in the military and we got station in Hawaii and the bio-dad is in Texas.

    No. You have to have the signed consent of the father in a format approved by the Court. No way around it.

    Has the father ever been acknowledged legally as the father - have you pursued him for support, is their a Court order for support/visitation? If he doesn't want to sign for adoption the thought of having to go to Court and being Ordered to pay support until the child is 18 may very well cause him to change his mind about signing!

    It will be actually harder than if the father was on the birth certificate.
    You will now have to prove to the court how the father is, and get them to sign their rights away to allow the adoption..

    Since you will need an attorney to draw up the adoption petition, its best to contact one to deal with the whole issue. They can take care of getting the bio father's rights terminated.
