Can my husband adopt

I have an eight year old he has never met his dad. I have given him the opportunity to meet his son and he will not. He is paying child support, but does not want to meet my son. If I can get him to sign over his rights (which I know he will) Could my husband adopt him?

In fact you would have to get him to relinquish his rights to clear the way for adoption. Realize though that adoption means your husband now takes full responsibility for your son. This means the father would also no longer have to pay child support. Obviously that's his incentive to sign over rights.
