If he is creating a danger to you call the police or get a court order to keep him away from you. If you want him out for good you must follow the eviction laws of CA. California Tenants - California Department of Consumer Affairs

What do you mean you "tried" to give him a notice? Did you hand him a notice with a deadline to vacate or not?

If you did and he did not vacate by the deadline, then you go to your local housing court and file for an eviction order. Should have done so the next day.

If he still refuses to leave after the court issues an eviction order, then you hire a sheriff to physically remove him.

The problem here is PROVING she is unsafe. Just saying you feel unsafe is not enough. There generally needs to be proof of previous violence to get a court to issue a restraining order.

First, I have no idea what you just said. I THINK you said to call the authorities and have him removed.

She needs to get an Order of Protection OR evict him because that is his residence.

Please don't give legal advice when you don't know the law.

Where did you read that "nowhere will let you be unsafe in your home 30 days or not?"

I was trying to message you back so I can understand how I insulted judykaylee because I was insulted is the reason I posted as I did. I was put on the spot. An basically I am feeling as if I'm unwelcome to post my opinion here because I'm told I'm wrong for posting my opinion. An then being called out on it for saying something. The reason I am putting it here is because it won't let me message you an I would like to understand this matter.

Maybe I can explain. (Scott is offline right now.) This is a Law board. Opinions are not supposed to be posted. I did that once, got scolded, and then realized what I had done.

Anyone responding on a Law board must be very careful to give correct legal information that pertains to the state or country that the questioner lives in. We don't want to mislead people or give them false hope or even put the site in danger of being sued for giving out erroneous information.

That's why I rarely post on a Law board. I'm not a lawyer nor do I know the law well enough to explain something to someone.

I can tell you myself what happened. This is a legal board. This is where people come for legal ADVICE, according to the law, not opinions. This is also not a chat site. We all come from different places here - Attorneys, educated support staff, people who do great legal research.

You said: "if he is making you fear for your safety call the authorities to have him removed as far as i know nowwhere will let you be unsafe in your own home 30 day sor not."

I said: "First, I have no idea what you just said. I THINK you said to call the authorities and have him removed. Where did you read that "nowhere will let you be unsafe in your home 30 days or not?"

Quite frankly your response was so garbled that it was difficult to understand. Note I also said "Please." Your LEGAL OPINION (and this is, again, a legal board) was WRONG.

You then came back with: "by not thinking with an open mind an thinking of the different situations that a person could be in. an shooting down other opinion which is the personal fredom of the usa."

Aside from waving the US flag this makes no sense and is INCORRECT legal advice. Having an open (or closed) mind has NOTHING to do with what the law states.

Again - maybe you're right and I'm wrong. Please tell me where you found the LEGAL information you are posting.

I don't know why you couldn't respond to my message. Even though you may not be able to receive PMs, you should have been able to reply. I would have removed this message as well because it is off topic, but since you have gotten some responses, I'll leave it stand. I reviewed what I said in that message and I think I was clear about what you did wrong.

Finally, your negative rating was also inappropriate and against our rules

rileymichael does not find this helpful : by not thinking with an open mind an thinking of the different situations that a person could be in. an shooting down other opinion which is the personal fredom of the usa.

As Judy said, this is meaningless. It has no bearing on what was posted nor on this board. This is a privately owned site and you have to adhere to the rules of this site. This was clearly a comment in revenge for some perceived slight that does not exist. It might pay for you to reread what you post several times before you hit the Submit button. You may think what you are typing is clear, but its not.
