This requires an attorney. You either need the other parent's consent or a court order permitting you to do so. There are a variety of scenarios you can arrange. For example, they might be able to temporarily take guardianship of the child as foster parents if you just need some time, or if it needs to be a permanent arrangement, the grandparents can adopt the child if both parents consent or the court permits it to move forward. You can't do this on your own though so call a lawyer.

If you do not have money for an attorney you can get either Child Protection Services or Department of Children & Family Services involved. In order for an adoption, parental rights would have to be terminated. If the grandparents want to raise the children they can hire an attorney and do a guardianship which will provide them with most legal rights as far as getting them in school, using them as an exemption for taxes and any medical care the may need.

Do the grandparents want to raise the children?

It is hard on the children to be in the foster care system. These kids have a ton of baggage and a lot of times the foster parents can only deal with so much.

Please think hard and long about what you are about to do to your children's lives.
