Is there any grace period after the rent is due in California before a 3 day notice is served?

Actually NO - there is no grace period by statute and most professional landlord/mgmt leases have the wording that a pay or quit may be served at any time.

State of California landlord/tenant law does not address this issue. If there's nothing in the lease, then there is NO grace period.

It's up to the Landlord. It should be documented in your rental agreement.
It can be set by the Landlord for anything from zero to 5 days usually. I have mine set at
The 5th day of each calendar month if post marked by 5pm. Rent is not late. If post marked after 5pm on the 5th calendar day of each month it is late and a late fee applies. That is MY terms of MY rental agreements though.

Yes grace ( and us preachers know all about grace) time frames are set by contract, so what ever your wrntten agree says is what it is. If not in writing, the landlord may set ( and change) their rules as they wish.

You do not have to give one at all, a lot of our government housing in this area have no grace time frame, it is expected prior to the 1st.
I am a softy, I allow a 10 day time frame on my rentals but I have farily high late fees if it is latter than the 10th.

In California, there is no grace period. There is no law in California stating that there is such a thing as a grace period. The landlord can legally proceed with the first step of eviction the day after the rent is legally due but unpaid. Straight from California's Landlords Lawbook, Nolo's guide.

I was just searching to see if there was a law regarding renters grace period and late fee laws as well and I came across this web site that states that it is illegal to charge late fees at all to tenants. California Tenant Law - Free legal advice for California renters' rights
Its pretty interesting. Good info to know.

Don't know if anyone will see this 2005 thread but that is most definitely not true in States other than California - and I don't know about California.

See page 28 - http://www.dca.ca.gov/publications/l...k/catenant.pdf - late fees are legal in California if they are structured correctly and in the lease.
